Suspension of Driver’s License
Don’t Let a DUI Charge Keep You Off the Road
One of the first things that happens when you’ve been arrested for a DUI is having your driver’s license suspended. Whether you’ve been formally charged with a DUI, or you’ve refused to take a blood alcohol test, your license may be automatically suspended. Just because you have your license taken away, however, doesn’t mean you’re not going to be able to drive for a long period of time. We have experience fighting for your right to drive, which is an important part of our overall defense strategy.
Prior to Your DUI Trial
When your license is suspended immediately following a DUI arrest, you will have 30 days to file an appeal with the DMV. If you fail to file the appeal, you won’t be able to get your license back until after your DUI trial is completed. If you do file the appeal, you’ll need to go through a DMV hearing to request your license be reinstated.
After Your DUI Trial
If you are found innocent of the DUI charges, or the charges are thrown out, you will of course be able to get your license back right away. If you are found guilty, or plead guilty, however, it is another story. By default, the courts will install an ignition interlock device to prevent future driving under the influence for a given period of time depending on how many convictions for DUI you have had. If you registered a .15 or above, or refused the sobriety test, then your license will be suspended. Here at Beaufort DUI, however, we know that driving is essential for most people, so we will fight on your behalf.
We can often convince the judge to allow you to drive, at least on a limited basis. While every case is unique, we can request that you be able to drive back and forth to work, school, appointments, and more. We will discuss your specific needs, and in the event that you are found guilty, fight for exactly what you need when it comes to driving privileges.
